The framework for our personal work together in sport.
1. Provider and scope
These terms apply to individual sports coaching, the initial neurofunctional screening and neuroathletics training provided by Tino Both, Allinger Straße 18, 94474 Vilshofen an der Donau, Germany. Contact: tino@neuroathletik-bayern.de, +49 160 7468115.
The services agreed before the contract is concluded and these incorporated terms apply. Individual agreements take precedence. For clubs or teams, the scope, price and organisation are defined in a separate offer. Future education courses are not covered by these terms.
2. Enquiries and conclusion of the contract
The offers presented on this website are an invitation to get in touch. An appointment request through Zeitfenster buchen is non-binding and does not create a payment obligation. An acknowledgement, reservation or appointment notification from the booking tool alone does not constitute a contract for a paid service.
For a paid service, Tino and the client personally agree on the service, price, date and location. Before entering into a binding agreement, the client receives these terms, the service description and, where applicable, information on the right of withdrawal. The contract is concluded through matching personal declarations by both parties, which may also be made by email. The contract documents are then provided in a form that can be saved. The contractual language is German.
3. Nature and scope of the service
The obligation is to provide the agreed personal service. Its content, duration and price are set out in the Service description or in the individual offer. Exercises are selected and adapted according to the starting point, the sporting task and the response during the session.
No specific performance improvement, freedom from symptoms or sporting result is promised. The sports-related assessment is not a medical diagnosis. The service does not replace medically necessary examination or treatment.
4. Prices and payment
The stated customer prices are final prices. The free initial call costs €0. The initial screening costs €210 for 90 minutes; the four-session package costs €549 and the eight-session package €999, with 60 minutes per package session. The initial screening is not included in the package price.
Coaching packages are paid in full before the first package session. For individual services, payment is due according to the agreed invoice; unless otherwise agreed, the statutory rules on payment dates apply. The payment method and invoice details are provided when we make the personal agreement. Additional services arise only by prior agreement.
Appointments away from my location incur an additional €0.50 per kilometre driven and €140 per hour of planned travel time, covering both outward and return journeys. The location, travel costs and total price are agreed before the contract is concluded. Package discounts do not apply to travel costs.
5. Coaching packages
A package comprises the agreed number of personal sessions. Content and intervals are agreed individually. There is no subscription or automatic renewal.
No fixed contractual expiry date is agreed for using the package sessions. Appointments are arranged according to availability and your training schedule. Statutory limitation periods and termination rules remain unaffected.
Withdrawal or valid termination is settled in accordance with the applicable statutory rules. Payments for services not provided are not retained as a flat charge merely because a contract ends. Statutory claims for remuneration or compensation remain unaffected.
6. Cancellations, rescheduling and missed appointments
Agreed appointments can be cancelled or rescheduled free of charge up to 24 hours before the start. Notification by email, phone or an available management function in the booking tool is sufficient. We agree on the new appointment time together.
There is no fixed cancellation charge for later cancellations or non-attendance. Payment for time lost may be claimed only where a legal basis exists in the individual case. Saved expenses and other earnings that must be credited are taken into account. Any claim will be explained clearly; the client may demonstrate that no claim, or a smaller claim, exists. A session is not charged in full as completed and then charged again.
If Tino has to cancel an appointment, no cancellation charge applies. Where possible, we arrange a replacement appointment. If an owed service becomes permanently impossible, payments for that unprovided service are refunded; further statutory rights remain unaffected.
7. Participation and delivery
Individual coaching is available from age 12. For minors, the service is commissioned by their legal guardians or with their valid consent. Relevant limitations in exercise capacity and changes during a session should be reported so that exercises can be adapted or interrupted. A personal health declaration does not replace necessary medical assessment.
Coaching preferably takes place in person in Vilshofen an der Donau. Sessions at the client’s training location and supplementary online coaching are agreed separately. There is no general entitlement to coaching or availability outside the agreed sessions.
8. Statutory rights and liability
Statutory termination rights and any applicable rights of withdrawal remain unaffected. Liability is governed by statutory provisions. In particular, there is no exclusion of liability for injury to life, body or health.
9. Withdrawal and privacy
Consumers generally have a statutory right of withdrawal for distance contracts and contracts concluded away from business premises, unless a statutory exception applies. The withdrawal information and model form are available on a separate page and are provided when the relevant contract is concluded. Cancelling an appointment and withdrawing from a contract are different declarations; withdrawal need not be described as an appointment cancellation.
